Terms and Conditions (AGB)

1. Introduction

1.1. These Terms and Conditions govern the use of the premises of Escape Company GmbH, St. Gallen (also referred to below as “we”, “our” or “us”).

1.2. These Terms and Conditions apply to all customers (also referred to below as “users”) who use the facilities of Escape Company GmbH. By booking a game and by entering our premises, users agree to these Terms and Conditions.

2. Information about Escape Company GmbH

2.1. We offer team games for people aged 10 to 99. Children up to the age of 16 may participate only when accompanied by an adult.

2.2. Customers and anyone interested in our services can contact us by email at info@escapecompany.ch or by phone on +41 71 722 33 55.

2.3. Opening hours: games may take place daily between 10:00 am (first start time) and 11:30 pm (end of the last game). Our office at Unterer Graben 1 is not continuously staffed during these hours. If you would like to meet us other than to play a booked game, please arrange an appointment by phone or email. We can usually be reached by phone on weekdays between 10:00 am and 6:00 pm, and occasionally outside these hours. If your enquiry is urgent and you cannot reach us promptly by phone, we recommend sending an email.

3. Conditions of Use

3.1. Users agree to treat the facilities of Escape Company GmbH with care. Escape Company GmbH reserves all rights to claim compensation for deliberate damage to the facilities, tools, equipment or layout. Our staff (the “game master”) may also end the game if a participant damages the facilities or players fail to follow our staff’s instructions.

3.2. Users agree to use the company’s games and facilities at their own risk and on their own responsibility. Escape Company GmbH is not liable for damage, including injury to health or damage to property, resulting from failure to follow our instructions or these Terms and Conditions, or from negligent use of our games and facilities.

3.3. Escape Company GmbH reserves the right to refuse access to its games and facilities to anyone who, in our staff’s assessment, is unable to participate in accordance with our safety standards.

3.4. Customers agree to pay the admission price shown in our official price list at www.escapecompany.ch, or the price agreed in advance, for the use of our games and facilities. Payment must be made within the payment period stated on the invoice or immediately after the game.

3.5. Before entering our premises, users agree to provide Escape Company GmbH with the names and contact details required, normally one name and email address per group. These details will not be shared with third parties or used for advertising unless the user has expressly agreed to this.

3.6. The games offered by Escape Company GmbH are not recommended for people with heart conditions, high blood pressure, claustrophobia or similar conditions. Anyone affected should contact us before booking.

3.7. Entry to the premises of Escape Company GmbH while under the influence of alcohol, other mind-altering substances or illegal substances is prohibited. Bringing alcoholic drinks or drugs into the premises, or consuming them there, is also prohibited unless we have expressly permitted moderate consumption for a special occasion.

4. Contract

4.1. A binding contract between you and us is formed when a booking reference and/or an appointment is assigned, whether automatically through the booking system, by phone or by email.

5. Cancellations & Changes by You

5.1. Player numbers for a single game. If you have booked one game, you may change the number of players without an amendment fee, including at short notice, provided the group stays within the game’s minimum and maximum player limits and the booked game goes ahead. The final game price is based on the actual number of players and the price list in effect when you made the booking. An adjustment to the game price is not an amendment fee.

5.2. Free cancellation or rescheduling. The same deadline applies to all bookings: you may cancel booked games or, subject to availability, reschedule them free of charge up to 24 hours before each game starts. This also applies to bookings with several games and to cancelling the entire booking. For a free cancellation, we refund any participation fees already paid for the cancelled games within one week.

5.3. Cancellation after the free cancellation deadline. If you cancel a game less than 24 hours before it starts, you must choose one of the following three options for each cancelled game:

  • Cancellation fee: Pay CHF 50 per cancelled game.
  • Voucher: Buy a voucher equal to the value of the cancelled game. If you choose this option for several games, the voucher value equals the total price of those games. The CHF 50 cancellation fee per game does not apply to those games.
  • Rescheduling: Move the affected game to a new slot, subject to availability, without a rescheduling fee. The new appointment must be agreed with us by phone or email no later than the day of the original game. The new game itself may take place on a later day.

5.4. Team events with several games. The same 24-hour deadline before each game starts applies whether you cancel individual games or the entire booking. For a cancellation at shorter notice, you must choose one of the options in section 5.3 separately for each cancelled game: a CHF 50 cancellation fee, a voucher equal to that game’s value, or rescheduling that game.

You must notify us by phone or email of changes to player numbers at least 24 hours before the team event starts. As long as all booked games go ahead and each game’s player limits are respected, there is no amendment fee; game prices are based on the actual number of players as described in section 5.1. If a smaller group means fewer games are needed, the games no longer needed count as cancellations. Those games are subject to the same 24-hour deadline or, for late cancellations, the choice of a cancellation fee, voucher purchase or rescheduling for each game in section 5.3. This also applies if it only becomes clear on arrival that fewer games will be played.

5.5. No-shows. If you do not attend a booked game, even without notifying us beforehand, you may choose between a CHF 50 cancellation fee per missed game and buying a voucher equal to the total value of those games. Rescheduling without a fee remains possible if it is agreed with us by phone or email no later than the original event day (section 5.3).

5.6. Contact and settlement. We accept cancellations and changes by phone or email. Please provide your booking reference. For St. Gallen, contact +41 71 722 33 55 or info@escapecompany.ch; for Lucerne, contact +41 41 220 23 80 or luzern@escapecompany.ch. An invoiced cancellation fee must be paid within one week. Payments already made will be taken into account when settling the booking. In cases of particular hardship, we may reduce or waive the cancellation fee.

5.7. Arriving on time. Please remember that Escape Company GmbH offers live events. Our rooms are prepared specifically for each booking and reserved for the booked period. You are responsible for arriving on time and allowing for delays caused by traffic, public transport or other factors. Ideally, your entire group should arrive 10 minutes before the game; arriving by the booked start time is essential. If you are late, we reserve the right to shorten the maximum playing time by the length of the delay. This is particularly necessary if other games are scheduled immediately afterwards.

6. Cancellations & Changes by Us

6.1. We may occasionally need to correct details or errors, or make changes. As a result, we may be unable to run a confirmed game, or to run it as planned. Providing a service may also become impossible for external reasons, such as the landlord terminating the lease for the venue. In such cases, we inform the affected customers and try to find the best possible solution. If no other solution is available, we reserve the right to cancel the booking unilaterally. Any participation fees already paid will be refunded within one week.

6.2. Force majeure: unless these booking conditions expressly state otherwise, we cannot accept liability or pay compensation if we are prevented from providing a service, if a service is disrupted, or if you suffer other damage or loss as a result of force majeure. In these booking conditions, force majeure means an event that the provider of the relevant service could not have foreseen or prevented despite taking all due care. Examples include war, unrest, civil war, terrorist activity or the immediate threat of terrorist activity, labour disputes, bank collapse, comet impacts, aircraft crashes, natural or nuclear disasters, dangerous weather conditions, fire and comparable events beyond our control.

7. Vouchers

7.1. Gift vouchers can be ordered using the designated online form, by email, by phone or in person at our office.

7.2. A binding contract between Escape Company GmbH and the voucher buyer is formed as soon as the buyer confirms the order by selecting “Buy now” in the form or confirming their intention to order in another way.

7.3. Vouchers cannot be exchanged for cash, either in full or in part. To make the best use of a voucher, we therefore recommend attending with at least the number of players shown on it.

7.4. Changes to player numbers are governed by section 5. Any resulting price difference can be paid during booking or on site after the game. The price list in effect when the booking was made applies.

7.5. Vouchers for one person may only be redeemed for a game with at least two players; we do not run games for one person. When booking a game for two to six people, the game price is reduced by the voucher’s value.

7.6. All our vouchers are valid for at least five years. However, we reserve the right to restrict voucher redemption in certain circumstances, as described in section 6.

7.7. All our vouchers are valid for all our missions. Any missions pictured on a voucher are for illustration only. We reserve the right to change our missions or location between the purchase and redemption of a voucher.

7.8. The voucher holder, for example the recipient of a gift voucher, simply chooses an available slot for their preferred mission on escapecompany.ch and books the event by entering the voucher code.

8. Confidentiality

Users agree not to share any game elements of Escape Company GmbH with third parties, including tasks, layouts, puzzles, furnishings, gameplay and game structure, or to use them for their own or anyone else’s commercial purposes. Taking photos or videos on our premises is permitted only with our written consent.
